The dispute over Transbrasil land at airports managed by Infraero gained new ingredients this week. The president of the Federal Court of Auditors, Adylson Motta, accepted a representation filed by Oceanair Linhas Aéreas, in which the company proposes to compete, in a public bidding process, for the Transbrasil land that Infraero intended to transfer to Gol Transportes Aéreos SA, without bidding. President Adylson Motta wrote, on December 16, that “the facts brought to the attention of this Court are very serious”. Motta orders that his order on the non-bidding be “sent to the Chief Minister of the Civil House of the Presidency of the Republic, Dilma Rousseff, and to the Vice President of the Republic and Minister of Defense, José Alencar”.
Transbrasil disputes with Infraero the airport areas where it maintains its facilities at Congonhas Airport. Transbrasil has been in possession of these areas since its creation (50 years) and built all the buildings and hangars there at its own expense. The dispute refers to late payments from Estonia Email List Transbrasil due to the temporary suspension of its activities. There are several actions on the matter being processed in the Federal Court of Brasília, including actions in which Transbrasil seeks recognition of credits before Infraero for excess payments demanded by this public company. On December 8th, Infraero signed an Area Use Concession Agreement with Gol, covering part of the airport areas being disputed with Transbrasil.
Transbrasil's Legal Department maintains that “the contract was concluded without bidding” contrary to the Federal Constitution (articles 37 and 175), Law 8,666/93, article. 2nd, and the Tenders and Contracts Regulation itself approved by the collegiate board of Infraero, published in the Official Gazette of the Union of August 4, 1998, section I, pages 44 to 53, and approved on June 23, 1998 by the Minister of Aeronautics through letter 159/CHGM/1014”. Now Oceanair, an airline competing with Gol interested in exploring the same area, has also decided to challenge the contract between Infraero and Gol. Oceanair has 20 planes, compared to Gol's 30. On the 20th, in a four-page handwritten order, federal judge Jirair Aman Mereguian, from the Federal Regional Court of the 1st Region, accepted a request from lawyer Marcelo Campos, from the firm Dejalme de Campos Advogados, to suspend the effectiveness of the signed contract between Infraero and Gol.
